empowHER Commerce LLC, doing business as HER In Focus ("HER In Focus," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through [joinherinfocus.com] (the "Website"), our membership community and portal hosted on Circle (the "Community"), our events, and related communications (together, the "Services"), how we use and share it, and the choices and rights available to you. This Policy should be read together with our Terms of Use.
1. Children's Privacy
The Services are intended for professional adults and are not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn we have inadvertently collected such information, we will delete it. Contact us at [hello@joinherinfocus.com] if you believe a minor has provided us information.
2. Information We Collect
Information you provide to us:
- Application and onboarding details (name, business/company information, role, email, LinkedIn or social profiles, location, and responses to application questions);
- Account and profile information within the Community (profile photo, bio, industry, interests);
- Payment and billing information (such as name, billing address, and card details) — processed by Circle's integrated payment processor; we do not directly store full card numbers;
- Content you post or share (posts, comments, direct messages, event RSVPs, testimonials, feedback);
- Communications with us (support requests, emails, survey responses).
Information collected automatically:
- Usage data (pages viewed, features used, referring URLs, timestamps);
- Device and technical data (IP address, browser type, operating system);
- Cookies and similar technologies (see Section 6).
Information from third parties:
- Circle, our membership platform provider, in connection with operating the Community (see Section 5);
- Event and sponsor partners, where you register for a co-hosted or sponsored event and consent to information sharing;
- Publicly available professional information (for example, LinkedIn) used to evaluate membership applications.
3. How We Use Your Information
We use personal information to: operate, maintain, and improve the Services; process membership applications, billing, and renewals; facilitate the Community, events, and the job board; communicate with you (including newsletters and announcements, which you may opt out of); personalize your experience; maintain security and prevent fraud or abuse; and comply with legal obligations.
4. How We Share Your Information
We share personal information with:
- Circle, our membership platform provider, which hosts the Community and processes related data on our behalf (see Section 5);
- Service providers who support our operations (payment processing, email and CRM tools, automation and analytics providers, hosting), under confidentiality and data-protection obligations;
- Other members, to the extent you choose to share information in your profile, posts, or community spaces — treat anything you post in the Community as visible to other members;
- Event co-hosts and sponsors, only where you register for or attend a co-branded event and where disclosed to you at that time;
- Successors, in connection with a merger, acquisition, financing, or sale of assets;
- Legal and safety purposes, where required by law, to protect rights, or to prevent harm.
We do not sell your personal information for money. To the extent applicable state law defines certain advertising-related data sharing as a "sale" or "share," see Section 8 for your choices.
5. Circle: Our Membership Platform Provider
Our membership Community and Portal are built and hosted on Circle, a technology platform operated by CircleCo, Inc. When you apply for or use the Community, Circle collects and processes personal information (such as your account details, posts, messages, and usage data) on our behalf, under its own privacy notice, available at circle.so/privacy. We encourage you to review Circle's privacy notice in addition to this Policy. We are not responsible for Circle's independent processing of information outside the scope of operating our Community.
6. Cookies and Tracking Technologies
The Website and Community use cookies, pixels, and similar technologies to remember preferences, understand usage, and support analytics and marketing. You can control cookies through your browser settings; disabling cookies may limit some features. We and our analytics or advertising partners may use this data for interest-based advertising; you can opt out of certain interest-based ads through the Network Advertising Initiative (optout.networkadvertising.org) or the Digital Advertising Alliance (optout.aboutads.info).
7. Data Retention
We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements, after which we delete or anonymize it.
8. Your Privacy Rights
U.S. state privacy rights. Depending on your state of residence (including California, Colorado, Connecticut, Virginia, Utah, and other states with comparable laws), you may have the right to know, access, correct, delete, or obtain a copy of your personal information, and to opt out of certain sharing for targeted advertising. UK/EU rights. If you are located in the UK or European Economic Area, you have rights under the UK GDPR or GDPR to access, correct, delete, restrict, or object to our processing of your personal information, and to data portability. Our legal bases for processing include performance of our agreement with you (membership), our legitimate interests (operating and improving the Community), your consent (marketing), and legal obligation. You may lodge a complaint with your local data protection authority (in the UK, the Information Commissioner's Office).
All users. You may update your account information directly in the Portal, unsubscribe from marketing emails using the link in those emails, and request access to or deletion of your information by emailing [hello@joinherinfocus.com]. We will respond within the time required by applicable law.
9. International Data Transfers
We and our service providers (including Circle) are based in the United States. If you access the Services from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data protection laws than your home country. Where required, we rely on appropriate safeguards for such transfers.
10. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Third-Party Links
The Services may link to third-party websites (including sponsor, partner, and social media sites) we do not control. This Policy does not apply to those sites, and we encourage you to review their privacy policies.
12. Changes to This Privacy Policy
We may update this Policy from time to time. We will post the updated Policy with a new Effective Date and, where changes are material, provide additional notice (such as email) before they take effect.
